IP Australia: Upcoming fee changes

You are here: Home / Intellectual Property & Trade Marks / IP Australia: Upcoming fee changes

August 28, 2020 by bolter

IP Australia will implement its new fee structure from 1 October 2020, including some increases in its registration fees.

The fee structure changes mostly affect patent applicants, patent renewal fees and trademark applications. The changes aim to support innovators by balancing IP Australia’s charges with costs of doing business while increasing flexibility and efficiency. You can find IP Australia’s in-depth overview of their changes here.

Trademarks

Trademark application fees for standard trade marks and Madrid Protocol applications will increase to AUD 400.00 per class. Currently, IP Australia charges $330.00 per class for a standard application and $350.00 per class under a Madrid Protocol application. So, there will be an increase in costs associated with trade mark applications in Australia.

Patents

From 1 October 2020, you will see changes to patents excess claim fees. They will be split into two tiers with prices as follows: AUD 125.00 per excess claim up to 30 claims, and AUD 250.00 per excess claim greater than 30 claims. Patent renewal fees will also see an increase.

The fee changes will flow through to IP Australia’s online portal.

You have until 1 October 2020 before the fee changes kick into gear. If you want to learn more about intellectual property or how you can register and secure the valuable IP of your startup, feel free to reach out to the Bolter Squad today.
